TERMS OF SERVICE AGREEMENT

This Terms of Service Agreement (the "Agreement") is entered into between Energized Living (referred to as "Company", "we", "us", or "our") and the customer (referred to as "Customer", "you", or "your") for the provision of our services in the Health and Wellness industry. By using our services, you agree to be bound by the terms and conditions set forth in this Agreement.

1. Services: Energized Living offers various health and wellness services, as described on our website or as otherwise agreed upon between the parties. The specific details of the services provided will be outlined in separate agreements, proposals, or documentation where applicable.

2. No Refunds: All sales are final. Energized Living does not offer refunds for any services rendered or products purchased. By engaging our services, you acknowledge and agree that no refunds will be provided under any circumstances.

3. No Transfers: Services provided by Energized Living are non-transferable. You may not transfer or assign any rights or obligations under this Agreement without our prior written consent.

4. 24 Hour Cancellation Notice: In order to reschedule or cancel any appointments with Energized Living, you must provide a minimum of 24 hours' notice. Failure to do so will result in the full charge for the scheduled service.

5. Results: Energized Living is dedicated to providing you with the tools, guidance, and support necessary for your health and wellness journey. However, it is important to understand that individual results may vary. The outcome and success of your journey depend on your personal effort, commitment, and consistency. We do not guarantee any specific results or outcomes.

6. Confidentiality: Any information or data disclosed by you to Energized Living during the provision of services will be treated as confidential and will only be used for the purpose of providing the services outlined in this Agreement. We will not disclose, share, or sell your information to any third party without your prior written consent, unless required by applicable law.

7. Intellectual Property: All intellectual property rights, including but not limited to trademarks, copyrights, trade secrets, and patents, related to Energized Living's services and materials provided, shall remain the sole property of Energized Living. You agree not to reproduce, distribute, modify, or create derivative works of any materials provided by Energized Living without our prior written consent.

8. Limitation of Liability: To the fullest extent permitted by law, Energized Living shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or relating to the services provided under this Agreement, including but not limited to personal injury, loss of profits, loss of data, or any other commercial or economic losses.

9. Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the state of Massachusetts, USA. Any dispute arising out of or related to this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located within the state of Massachusetts.

10. Entire Agreement: This Agreement constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings, whether oral or written.

By using our services, you acknowledge that you have read, understood, and agreed to the terms and conditions set forth in this Agreement.
